By accessing or using the Pixacolour email security gateway service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, you must not use the Service.
Pixacolour provides a cloud-based email security gateway that sits between the internet and your mail server. The Service includes:
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials, including API keys and authentication tokens.
You agree to notify us immediately at contact@pixacolour.com if you become aware of any unauthorized use of your account or any security breach.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must NOT:
By configuring your MX records to route email through Pixacolour, you authorize us to receive, scan, analyze, filter, and deliver email on behalf of your organization. This includes inspecting email headers, body content, URLs, and attachments for security threats.
We process email content exclusively for the purpose of security analysis and threat detection. We do not use email content for advertising, profiling, or any purpose unrelated to the Service.
Pixacolour commits to the following uptime guarantees based on your subscription plan:

Scheduled maintenance windows are excluded from uptime calculations. SLA credits must be requested within 30 days of the incident and are applied to future invoices.
The Service is billed on a monthly subscription basis. All fees are non-refundable except as required by applicable law or as explicitly stated in our SLA. We reserve the right to modify pricing with at least 30 days' prior written notice.
If payment is not received within 15 days of the due date, we may suspend access to the Service. Continued non-payment for 30 days may result in account termination and deletion of associated data.
The Service may quarantine emails that are identified as potentially malicious or unwanted. While we strive for maximum accuracy, Pixacolour is not liable for false positives (legitimate emails incorrectly quarantined) or false negatives (threats not detected).
Quarantined emails are retained for 30 days, during which they can be reviewed and released by authorized administrators. After 30 days, quarantined items are permanently deleted.
When processing email on your behalf, Pixacolour acts as a data processor on behalf of your organization (the data controller). We process personal data contained in email traffic only as necessary to provide the Service and in accordance with our Privacy Policy.

All rights, title, and interest in the Service — including detection algorithms, threat intelligence databases, machine learning models, user interface design, documentation, and trademarks — are and remain the exclusive property of Pixacolour.
You retain ownership of your email data and account content. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.
To the maximum extent permitted by applicable law, Pixacolour shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities, arising from or related to your use of the Service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid for the Service during the twelve (12) months preceding the event giving rise to the claim.
Either party may terminate these Terms at any time with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms or if required by law.
Upon termination, you must update your MX records to restore direct email delivery to your mail server. Pixacolour will cease processing email for your domain within 24 hours of termination and delete your data in accordance with our retention policy.
We may update these Terms from time to time. When we make material changes, we will notify you via email at least 14 days before the updated Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
These Terms are governed by and construed in accordance with the laws of the Italian Republic. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Milan, Italy.
